Invention protection registration

- Invention patent: an invention shall be eligible for protection in the form of the grant of an invention patent when it has the novelty, inventive nature, and susceptiblity industrial application

- Utility solution patent: unless an invention is common knowledge, an invention shall be protected in the form of the grant of a utility solution patent when it satisfies the novelty and susceptibility industrial application

- According to the Law on Intellectual Property, subject matter of intellectual property rights does not comprise all of technology fields. For example, scientific discoveries or theories, mathematical methods; presentations of information, human and animal disease prevention methods, diagnostic and treatment methods, etc shall be ineligible for protection.

- In accordance with the Law on Intellectual Property, Industrial property rights to invention is established on the basis of a decision of the National Office of Intellectual Property of Vietnam to grant a protection title. The inventors (or co-inventors) want to have right to invention they must have applications for registration of industrial property and submit it for National Office of Intellectual Property of Vietnam
